Terms and Conditions for Chiropractic Course

1. Course Description and Instructor Qualifications

   This chiropractic course (“Course”) is provided by Survivor Mountain LLC (“Provider”) and includes both in-person and online components. The Course is designed for educational purposes only. Participants acknowledge that many instructors are from different states and countries and may not be registered or licensed as chiropractors in the state or country where the Course is held. Instructors act solely in an educational capacity and do not provide chiropractic care or services during the Course. Any techniques or demonstrations performed are for instructional purposes only and are not conducted under the instructors’ professional licenses, if any. Participants perform or receive demonstrations under their own professional licenses, where applicable, and assume full responsibility for compliance with local laws and regulations.

2. Consent for Demonstrations

   Participants may engage in or receive hands-on demonstrations as part of the Course. By participating, you provide full consent to such demonstrations and acknowledge that they are performed with your voluntary agreement. You assume all risks associated with these activities, including but not limited to physical injury, discomfort, or aggravation of pre-existing conditions. The Provider, its instructors, employees, and affiliates are not liable for any injuries, damages, or losses resulting from demonstrations, whether performed on or by you.

3. No Monetary Value for In-Person Course with ArthroStim Kit

   When the in-person Course is purchased as part of Dr. Lindsey’s ArthroStim kit package, the in-person Course has no independent monetary value. Participants are not entitled to a refund, discount, or credit for the in-person Course if they are unable to attend. However, participants unable to attend the in-person Course may complete the online Course, which, upon passing required tests, provides certification equivalent to 10 hours of Continuing Education (CE) credits. Completion of the online Course is subject to the same terms and conditions outlined herein.

4. Cancellation and Refund Policy

   – Independent Course Purchase: If the Course is purchased independently (not as part of the ArthroStim kit package), participants may cancel their registration with at least 72 hours’ written notice prior to the Course start date. Upon valid cancellation, 25% of the Course fee will be retained by the Provider as a non-refundable administrative fee, and the remaining 75% will be refunded. Cancellations made less than 72 hours before the Course start date, or failure to attend, will result in forfeiture of the entire Course fee.

   – ArthroStim Kit Package: No refunds, discounts, or credits are available for the in-person Course component when purchased as part of the ArthroStim kit package, as outlined in Section 3.

   – The Provider reserves the right to cancel or reschedule the Course due to insufficient enrollment, instructor availability, or other unforeseen circumstances. In such cases, participants will be notified, and a full refund or rescheduling option will be offered.

5. Limitation of Liability

   To the fullest extent permitted by law, the Provider, its instructors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the Course, including but not limited to personal injury, property damage, loss of income, or failure to achieve educational or professional objectives. Participants assume all risks associated with attending the Course, including risks related to demonstrations, travel, or reliance on Course content. The Provider’s total liability, if any, shall not exceed the amount paid by the participant for the Course.

6. Participant Responsibilities

   – Participants must hold a valid chiropractic license or be enrolled in a recognized chiropractic program to participate in the Course, unless otherwise specified by the Provider.

   – Participants are responsible for ensuring that their participation, including performing or receiving demonstrations, complies with all applicable local, state, and national laws and regulations.

   – Participants must disclose any medical conditions, injuries, or limitations that may affect their ability to safely participate in demonstrations. Failure to disclose such conditions releases the Provider from any liability related to resulting injuries or damages.

   – Participants are responsible for their own travel, accommodation, and incidental expenses related to attending the in-person Course.

7. Intellectual Property

   All Course materials, including but not limited to handouts, videos, presentations, and online content, are the intellectual property of the Provider or its licensors. Participants may not reproduce, distribute, or share Course materials without prior written consent from the Provider. Unauthorized use may result in legal action and termination from the Course without refund.

8. No Warranty

   The Course is provided on an “as-is” basis. The Provider makes no warranties, express or implied, regarding the accuracy, completeness, or suitability of the Course content for any particular purpose. The Provider does not guarantee that participants will achieve specific professional or educational outcomes by attending the Course.

9. Force Majeure

   The Provider is not liable for failure to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, government regulations, or other emergencies. In such cases, the Provider may cancel or reschedule the Course, and participants will be offered a refund or rescheduling option as outlined in Section 4.

10. Governing Law and Dispute Resolution

   These Terms and Conditions shall be governed by and construed in accordance with the laws of  Oregon. Any disputes arising out of or in connection with the Course or these Terms and Conditions shall be resolved through mediation or arbitration in Oregon, with each party bearing their own legal costs. Participants waive the right to pursue class action lawsuits or claims against the Provider.

11. Entire Agreement

   These Terms and Conditions constitute the entire agreement between the Provider and the participant regarding the Course and supersede all prior agreements or understandings, whether written or oral. The Provider reserves the right to modify these Terms and Conditions at any time, with notice provided to participants.

12. Acknowledgment

   By registering for the Course, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You further acknowledge that participation in the Course is voluntary and at your own risk.
